Health risks from designer drugs: Further psychoactive substances banned

After already in the spring of 2023 several substances with a suspected psychoactive
Effect were listed in the narcotics directory ordinance. [1] , the Federal
Department of Home Affairs (FDHA) on October 9, 2023 at the request of Swissmedic a further 10
individual substances and a substance group controlled to prevent the misuse of new synthetic
substances to combat as narcotics.[2]

A substance group of synthetic cannabinoids as well as the individual substances HHCP, delta-9-
THCP, delta-8-THCP, H4CBD and other substances will be allowed in Switzerland from October 9, 2023.
are subject to authorization and may not be manufactured, traded or distributed. [3] Permits
can be applied for industrial and scientific use (Art. 7 para. 2 in connection with
Art. 4 and Art. 5 BetmG and BetmVV-EDI, Annex 6 List e). Not affected by the ban
are cannabinoids naturally occurring in the hemp plant such as CBD, CBC, CBG.

IG Hanf Schweiz welcomes the listing of the mentioned substances for the protection of the health of the
citizens as an important step. Likewise, the listing provided more legal certainty
created for the dealers in Switzerland.

At the recurring listing of synthetic and semisynthetic cannabinoids by the
EDI, it is clear that the issue has not been effectively resolved since 2011. An effective
Health protection can only be ensured in a regulated market for hemp and hemp products.

Sensible cannabis regulation forms the basis for youth and consumer protection, the
quality assurance as well as the fight against the black market and the sustainable development of the
Swiss Hemp Industry.
