1. scope
The GTC apply to the services provided by Herba di Berna AG (hereinafter referred to as Herba di Berna) and become applicable upon the conclusion of a contract. These GTC apply exclusively. Any conflicting or supplementary terms and conditions or any terms and conditions deviating from these GTC shall require Herba di Berna’s express written confirmation in order to be valid. The operator of this website is Herba di Berna AG.
2. legal framework
In Switzerland, Herba di Berna products do not fall under the Narcotics Act (BetmG) and are legally tradable.
For countries outside Switzerland:
Due to the constantly changing legal situation, it is impossible for us to provide information about the legal status of our products, which refer to countries outside of Switzerland.
You accept the personal responsibility to have informed yourself about the legal status that applies in your country in advance of placing an order for our products and confirm this by placing an order,
- that you have reached the age of 18.
- That the import and possession of our products is legal in your country.
By placing an order in the online store, you assume full responsibility regarding the legality of the products that we will send you as a result of the order.

Purchase contract
By accepting the General Terms and Conditions and clicking the button “Submit Order” in the “Checkout” of the webshop (www.herbadiberna.ch/shop), a purchase contract is concluded for the selected products in the shopping cart.
Delivery Switzerland
For orders placed before 15:00, delivery will be made the following day via Swiss Post (provided there are no delays at the post office itself).
Discounts and vouchers
A voucher code is a discount promotion issued by Herba di Berna AG or a partner for a limited period of validity on our online store or in our specialist store. Not all discount promotions are valid in the online store and in the specialist store at the same time. Only one voucher code can be redeemed per order. Cumulation of voucher codes is not possible.
A voucher code is linked to a discount promotion and can only be used during a defined period. Certain products may be excluded from the discount promotion.
A gift voucher cannot be purchased with a voucher code.
Vouchers must be entered directly when ordering, it is not possible to have them credited later. The voucher code may not be passed on to third parties.
Vouchers issued by the specialist store are not valid in our online store and can only be redeemed in the specialist store.
Terms of payment
The customer has the payment options specified in the order process. Herba di Berna is the direct contact for billing and payment issues for customers who purchase from the online store. The products delivered to the customer remain the property of Herba di Berna until full payment.
Prices and shipping costs
The prices are incl. Value added tax. Shipping costs are not included in the indicated prices, they will be charged additionally. Shipping costs: Fr. 9.00 for order amounts under Fr. 79.-. From 79.- shipping is free (exceptions: cuttings, young plants and glass bottles Fr. 9.00). Special requests (e.g. express shipments) will be charged additionally. The shipment will be made by Swiss Post. The requested delivery is usually handed over to the post office within two working days. In case of delay, we will inform you immediately.
Right of withdrawal
The purchase contract can be revoked by the customer in writing within 14 days after the goods have been received by the intended recipient without giving any reason. For this purpose, please return the goods in perfect condition. To meet the deadline, it is sufficient to send the order in time to:

Send the return with sufficient postage and enclose the original invoice. Unstamped returns cannot be accepted. We reserve the right to charge for any additional costs incurred due to improper return.
Herba di Berna reserves the right to demand reasonable compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice it to the customer.
Scope
Herba di Berna executes the orders according to the GTC valid at the time of the order. Deviating and/or supplementary agreements require the express written consent of Herba di Berna.

Legal notice
Every product available on herbadiberna.ch is legally available and consumable in Switzerland. According to Art. 4 para 1 lit a Therapeutic Products Ordinance we are not authorized to advise on health implications of CBD and hold that CBD is not intended for the prevention, diagnosis, treatment and cure of diseases.
Further, we do not recommend driving a vehicle after consuming any of our products. Driving ability could be impaired. Outside of Switzerland, consumption and possession of the products we distribute may be subject to criminal prosecution.
