Whenever there is movement in cannabis policy, we get excited. The current development on <strong>&#8220;Cannabis Legalization Switzerland 2025&#8221;<\/strong> is no exception. We say: Yes, finally a step forward &#8211; but please with brains and enough courage to be less than perfect.   <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>What is currently going on with THC legalization in Switzerland?<\/strong><\/h2>\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>On August 29, 2025, the National Council&#8217;s Social Affairs and Health Committee submitted the draft <strong>Cannabis Products Act (CanPG)<\/strong> for consultation &#8211; a milestone that will allow for open debate and broad participation until December 1, 2025. This will be followed by parliamentary steps and &#8211; in all likelihood &#8211; another referendum. <\/p>\n\n\n\n<p>The draft formulates clear guidelines:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Home-grown<\/strong>: Up to three plants per household are permitted.<\/li>\n\n\n\n<li><strong>Possession limits<\/strong>: 5 g in public areas, 75 g in private areas.<\/li>\n\n\n\n<li><strong>Sale<\/strong>: Exclusively via licensed, non-profit stores, with strict requirements such as maximum THC levels (20 % for flowers, 60 % for extracts), neutral packaging and a comprehensive ban on advertising.<\/li>\n\n\n\n<li><strong>Online offer<\/strong>: In addition, a <strong>state-controlled platform<\/strong> is planned <strong>for the whole of Switzerland<\/strong>, through which cannabis is to be distributed centrally and with legal certainty.<\/li>\n\n\n\n<li><strong>Prevention<\/strong>: Topics such as youth protection, consumer protection and an incentive tax are firmly integrated.<\/li>\n\n\n\n<li><strong>Revenue<\/strong>: The proceeds from the levy are to be used specifically to promote research, health programs and education.<\/li>\n<\/ul>\n\n\n\n<p>For us, this represents a politically ambitious attempt to start down the path of regulation on an equal footing &#8211; <strong>in a controlled, transparent and responsible manner<\/strong>.<br\/>However, we also see critical points:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cannabis would continue to be regulated by the <strong>Narcotics Act (BetmG)<\/strong>. This is not a complete legalization, but a <strong>decriminalization<\/strong>. <\/li>\n\n\n\n<li>In our view, an <strong>independent cannabis law<\/strong>, comparable to the regulations for tobacco or alcohol, would be more sensible and sustainable.<\/li>\n\n\n\n<li>The chosen solution at administrative level appears pragmatic, but could cause confusion in the long term.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"736\" height=\"1312\" src=\"https:\/\/www.herbadiberna.ch\/wp-content\/uploads\/thc-legale-schweiz-gesetzesentwurf-politik-2025.jpg\" alt=\"Cannabis legalization 2025 latest status\" class=\"wp-image-68618\" style=\"width:279px;height:auto\" srcset=\"https:\/\/www.herbadiberna.ch\/wp-content\/uploads\/thc-legale-schweiz-gesetzesentwurf-politik-2025.jpg 736w, https:\/\/www.herbadiberna.ch\/wp-content\/uploads\/thc-legale-schweiz-gesetzesentwurf-politik-2025-168x300.jpg 168w, https:\/\/www.herbadiberna.ch\/wp-content\/uploads\/thc-legale-schweiz-gesetzesentwurf-politik-2025-574x1024.jpg 574w, https:\/\/www.herbadiberna.ch\/wp-content\/uploads\/thc-legale-schweiz-gesetzesentwurf-politik-2025-416x742.jpg 416w\" sizes=\"auto, (max-width: 736px) 100vw, 736px\" \/><\/figure>\n<\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\"><strong>Science ahead &#8211; Z\u00fcriCan &amp; Bern show the way to THC legalization<\/strong><\/h2>\n\n<p>Various <strong>pilot projects<\/strong> <strong>for the<\/strong> <strong>regulated supply of cannabis<\/strong> have been underway in Switzerland since 2021 &#8211; first and foremost the well-known <em>Z\u00fcriCan<\/em> in Zurich. Under strict conditions, adults can legally purchase cannabis products manufactured by Swiss organic producers. The accompanying studies provide valuable insights: They show how consumer behavior, health aspects and black market interactions actually develop under legal conditions<a href=\"https:\/\/www.stadt-zuerich.ch\">(City of Zurich, Department of Health and Environment<\/a> \/ <a href=\"https:\/\/www.bag.admin.ch\">Federal Office of Public Health FOPH<\/a>).  <\/p>\n\n<p>But our home city of <strong>Bern<\/strong> is also following this path &#8211; with the <em><a href=\"https:\/\/mediarelations.unibe.ch\/medienmitteilungen\/2023\/medienmitteilungen_2023\/anmeldung_fuer_die_cannabis_studie_script_in_bern_und_biel_eroeffnet\/index_ger.html?utm_source=chatgpt.com\">SAFER <\/a><\/em> project <em>&#8211; Bern Cannabis Study<\/em>. The aim is to gather real empirical values instead of relying solely on theoretical assumptions.<\/p>\n\n<p>The <strong>University of Bern<\/strong> and the <strong>Institute of Social and Preventive Medicine (ISPM)<\/strong> are providing scientific support for the project. The focus is not only on product quality, but also on key questions such as: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Does legal access influence consumer behavior?<\/li>\n\n\n\n<li>Does regulation reduce risks and losses?<\/li>\n\n\n\n<li>How can the protection of minors be implemented in a practical and effective way?<\/li>\n<\/ul>\n\n<p>For us as a Bern-based company, this project is a matter close to our hearts. Because only by educating, testing and learning right on our own doorstep can we as a society establish <strong>healthy and fair rules<\/strong>. But digitally? There are loopholes lurking here.  <\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\">Common position with IG Hemp Switzerland<\/h4>\n\n<p>The positions of the <strong><a>IG Hemp Switzerland<\/a><\/strong> coincide in many points with our concerns:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Protection of minors and consumer safety<\/strong>: Only a regulated supply can sustainably suppress black market structures<a>(position paper on cannabis regulation<\/a>).<\/li>\n\n\n\n<li><strong>Local, sustainable cannabis economy<\/strong>: Instead of dependence on imports, Swiss producers, SMEs and agriculture need clear support<a>(position on importing cannabis<\/a>).<\/li>\n\n\n\n<li><strong>Licensing model for specialist stores<\/strong>: A market-oriented approach strengthens transparency, advice and product safety &#8211; state sales monopolies would tend to act as a brake<a>(position sales outlets &amp; organizational form<\/a>).<\/li>\n\n\n\n<li><strong>Realistic THC limits<\/strong>: A blanket 20% is not practical. Differentiated limits that take into account the realities of consumption are necessary in order not to artificially strengthen the black market<a>(position THC content of cannabis products<\/a>). <\/li>\n\n\n\n<li><strong>Exclusion of <a href=\"https:\/\/www.herbadiberna.ch\/en\/blog\/synthetic-cannabinoids\/\">synthetic cannabinoids<\/a><\/strong>: The credibility and safety of a regulated market depend on clearly distinguishing natural products from risky substances<a>(position of synthetic cannabinoids<\/a>).<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\">Why this debate is important<\/h4>\n\n<p>IG Hemp Switzerland rightly emphasizes that the regulation of cannabis is a great opportunity &#8211; for <strong>health protection, education and economic sustainability<\/strong>. Cannabis social clubs with a maximum of 500 members, joint cultivation (non-profit), but without a lounge for on-site consumption.  <\/p>\n\n\n\n<p><strong>Plus points:<\/strong> local cohesion, less illegal trade, social control.<br\/><strong>Limitations:<\/strong> strict bureaucracy, complicated access, possible undersupply.<\/p>\n\n\n\n<p>For us, CSCs are an inspiring option &#8211; as long as Switzerland does not lose its way in excessive bureaucracy, but creates space for flexible and diverse solutions. Only then can cannabis social clubs become a real tool for prevention, transparency and quality promotion. <\/p>\n<\/div>\n<\/div>\n\n<h3 class=\"wp-block-heading\">  Outlook &amp; our responsibility as Herba di Berna<\/h3>\n\n<p>Even though the legalization of THC is within reach, our mission at Herba di Berna remains the same: education, quality and responsible use of the cannabis plant.
